Strategic export controls
It is a criminal offence to export strategic or controlled goods that are subject to a sanction and embargo regimes without a specific licence from the Department for Business, Innovation & Skills (BIS). The export of some goods is also banned outright. The activities of agents and brokers, as well as sellers, are regulated. This page explains how controls operate and how traders can apply for a licence to export strategic goods.
Strategic export controls cover all equipment on the UK Strategic Export Control Lists. These include the UK Military List and the EU Dual-Use List of civilian items that also have military end-uses or that can be used in the development, production and maintenance of chemical, biological or nuclear weapons and the missiles to deliver them.
Controls can also apply to the export of goods that might be used in connection with military equipment or weapons of mass destruction, even if the goods are not on the Control Lists. Read our guide on Military End-Use Control guidance notes.
New controls apply to the brokering - which can include warehousing and shipping - of dual-use goods that could be used in connection with Weapons of Mass Destruction.
Controls are also in place on the trade of strategic controlled goods between overseas countries. These controls apply to all activities undertaken from within the UK and in certain circumstances to activities undertaken by UK persons whilst overseas. Legislation also controls activities of the transport sector concerning transport of military items, and trading goods between countries overseas.
Applying for a licence
All applications for licences to export military or dual use items controlled for strategic reasons are considered on a case-by-case basis by the Export Control Organisation (ECO), part of BIS. The chief task of the ECO is to process applications for licences to export strategic goods from the UK.
SPIRE is the ECO's fully electronic system for processing licence applications. You can apply for an export licence on SPIRE with BIS.
Banned goods
It is illegal to import or export some types of goods, including anti-personnel landmines, laser weapons or significant amounts of new nuclear material, or to export nuclear weapons or technologies to countries other than recognised nuclear weapons states. It is also illegal to import or export certain items that could be used for torture or capital punishment.
